Dagestan Parliament develops amendments to federal law on contract system

The Committee on Economic Policy, Investments and Entrepreneurship of the People's Assembly of the Republic of Dagestan has considered amendments to the draft law on amendments to Article 3 of the Law of the Republic of Dagestan "On establishing criteria for social, cultural and communal facilities, large-scale investment projects, for the placement (implementation) of which land plots are leased to legal entities without a tender".

The deputies decided to support the bill and to propose to include it on the agenda of the next session for adoption in the second final reading.

The members of the committee then considered the draft law on amendments to Article 104 of the Federal Law "On the system of contracts in the sphere of procurement of goods, works and services to ensure state and municipal needs". The document was drafted by parliament on the initiative of Dagestani Head Sergei Melikov, due to the fact that at the moment there are still attempts to become a winner using unreliable information on the experience of similar works. If violations are discovered after the contract is signed, there is no possibility of including the contractor in the Register of unfair contractors.

Thus, the transfer of a contract from the "performance" stage to the "performance completed" stage is a kind of protection for unfair suppliers (contractors, executors) from being included in the Register. The suppliers also have the right to apply to the court to postpone the deadline for obtaining the opportunity to perform the contract and transfer it to the "performance completed" stage.

The bill proposes to supplement Article 104 with a part stipulating that the Register must contain information on suppliers (contractors, performers) who executed contracts and submitted unreliable information on their compliance with the requirements for procurement.
